GENERAL TERMS AND CONDITIONS OF SALE - MOUCHOIR

These General Terms and Conditions of Sale (hereinafter "GTC") are concluded between the brand Mouchoir (EI-CASALE Mathieu), a sole proprietorship registered under number 84001043300018, with its registered office located at 32 rue Paul Bert, 31400 TOULOUSE, FRANCE (hereinafter "the Seller") and any natural person making a purchase on the website https://mouchoir-lamp.com (hereinafter "the Customer").

1. PURPOSE AND SCOPE

These GTC govern the sale of light fixtures and decorative objects. Any order placed on the site implies the Customer's full and unreserved acceptance of these GTC. Mouchoir reserves the right to modify these conditions at any time. The applicable conditions are those in effect on the date of the order.

2. PRODUCTS AND THE NATURE OF 3D PRINTING

2.1. Characteristics: Each light fixture is described with the greatest possible precision.
2.2. Digital Craftsmanship: The Customer is informed that Mouchoir products are created using a 3D printing process (FDM). By nature, this process leaves visible manufacturing layers (fine horizontal lines) and slight surface irregularities.
2.3. Acceptance of Specificities: These characteristics are an integral part of the "textile illusion" design and the brand's DNA. They are not considered defects, but rather the signature of our craftsmanship. By ordering, the Customer accepts these unique variations.

3. ORDERING AND CONTRACT FORMATION

The Customer selects their products and adds them to the cart. The contract is formed at the time of payment confirmation. A confirmation email summarizing the order is sent to the Customer.

4. PRICE AND PAYMENT

4.1. Pricing: Prices are indicated in Euros (€) including all taxes (VAT included). Delivery costs are calculated at checkout.
4.2. International Taxes: For deliveries outside the European Union, customs duties or local taxes may be required. These are the exclusive responsibility of the Customer.
4.3. Payment: Payment is due immediately. We use secure solutions (Shopify Payments, Stripe, PayPal). No banking data is stored by Mouchoir.

5. SHIPPING AND DELIVERY

5.1. Conscious Production: Our objects are often made-to-order in our French studio. A processing time (indicated on the product page) is added to the shipping time.
5.2. Transport: Packages are shipped with tracking. Mouchoir cannot be held responsible for delivery delays caused by the carrier.
5.3. Transport Damage: The Customer must check their package upon arrival. In case of a broken product, the Customer has 48 hours to contact customer service (with supporting photos) at mouchoir.lamp@gmail.com.

6. RIGHT OF WITHDRAWAL (RETURNS)

In accordance with Article L221-18 of the French Consumer Code:

  • Period: The Customer has 14 days after receipt to change their mind.

  • Conditions: The product must be returned in its original packaging, in perfect condition. Any product used, damaged, or soiled will not be refunded.

  • Return Shipping Costs: The shipping costs for the return are the exclusive responsibility of the Customer.

  • Refund: The refund will be issued within 14 days following the receipt and inspection of the product by us.

7. LEGAL WARRANTIES (MANDATORY IN FRANCE)

Mouchoir is liable for defects in the conformity of the goods to the contract (Art. L217-4 et seq. of the Consumer Code) and for hidden defects (Art. 1641 of the Civil Code).

Important Note: As mentioned in Article 2, textures related to 3D printing and minor color variations due to screen settings do not constitute a lack of conformity.

8. INTELLECTUAL PROPERTY

All elements of the site (texts, photos, design of the Volute lamp) are the exclusive property of Mouchoir. Any reproduction, even partial, is strictly prohibited and constitutes an infringement. The "Volute" design is a registered and protected model.

9. LIABILITY

Mouchoir cannot be held liable in the event of improper use of the light fixture (use of an unsuitable bulb exceeding the recommended power, exposure to excessive heat, etc.). Our lamps must be used exclusively with LED bulbs.

10. PERSONAL DATA (GDPR)

The information collected is necessary for order management. The Customer has the right to access, rectify, and delete their data by contacting mouchoir.lamp@gmail.com.

11. MEDIATION AND DISPUTES

In the event of a dispute, the Customer agrees to contact Mouchoir as a priority to reach an amicable solution. If no solution is found, the Customer may resort to a consumer mediator (in accordance with articles L611-1 et seq.). Otherwise, the French courts shall have exclusive jurisdiction.
